Terms & Conditions

Masayume Studio

1. SERVICE DESCRIPTION

Masayume Studio provides creative services including video production, graphic design, AI consulting, and visual content creation. All services are custom-tailored to client specifications.

2. PRICING & PAYMENT

2.1 Payment Terms

  • Projects under €500: Full payment required before project commencement

  • Projects over €500: 50% deposit required upon order confirmation, remaining 50% due before final delivery

  • All prices are quoted in Euros (EUR) and are VAT-exempt (SASU status)

2.2 Payment Methods

  • Stripe payment processor (credit cards, international payments)

  • Payment terms: Net 7 days from invoice date

2.3 Late Payment

Late payments may result in project suspension until payment is received.

3. PROJECT WORKFLOW

3.1 Revisions Included

  • Visual projects: 1 round of revisions included

  • Video projects: 2 rounds of revisions included

  • Additional revisions available at reduced rates unless otherwise specified in quote/invoice

3.2 Client Validation Process

  • Client approval required at key project milestones

  • Projects proceed based on timely client feedback

  • Important: Delays in client validation automatically void stated delivery deadlines

3.3 Project Abandonment

If no client response is received within 30 days after 3 follow-up attempts, the project will be considered abandoned with no refund.

4. DELIVERY & DEADLINES

4.1 Delivery Timelines

Estimated delivery times are provided in good faith but are not guaranteed. Timelines may be affected by:

  • Client feedback delays

  • Scope changes

  • Technical constraints

4.2 Delivery Delay Compensation

If Masayume Studio exceeds agreed deadlines due to our own delays, we offer compensation in the form of discounts on the current or future projects, but not full refunds.

5. CANCELLATION & REFUNDS

5.1 Before Project Commencement

  • 50% refund available if cancellation occurs before work begins

5.2 After Project Commencement

  • 25% refund available once work schedule is validated and project has begun

  • No refunds available after 50% project completion

6. INTELLECTUAL PROPERTY & CLIENT RESPONSIBILITIES

6.1 Client Rights

Upon full payment, clients receive full commercial rights to final deliverables for the agreed usage scope.

6.2 Portfolio Rights

Masayume Studio retains the right to showcase completed work in portfolios and promotional materials unless client specifically requests exclusivity (available as paid option).

6.3 Exclusivity

Complete exclusivity and removal of portfolio rights available upon request for additional fee.

6.4 Client-Provided Materials

Client warrants that they own or have proper authorization for all materials provided to Masayume Studio, including but not limited to:

  • Photographs of people, products, or properties

  • Logos, trademarks, and brand materials

  • Text content and scripts

  • Audio files and music

  • Video footage

  • Any other creative assets or intellectual property

Client agrees to hold Masayume Studio harmless from any claims arising from unauthorized use of third-party materials.

6.5 AI Tools Authorization

By engaging our services, client explicitly authorizes Masayume Studio to process provided materials through AI tools and platforms (including but not limited to LLMs, image generators, video generators, and other AI-assisted creative tools) as necessary for project completion. Client acknowledges that such processing may involve third-party AI services.

6.5 Usage Responsibility

Client is solely responsible for the lawful and ethical use of deliverables. Masayume Studio disclaims all responsibility for:

  • Misuse of created content for illegal, defamatory, or harmful purposes

  • Copyright infringement resulting from client's use of deliverables

  • Any consequences arising from client's application of our services

  • Third-party claims related to final content usage

7. LIMITATION OF LIABILITY

7.1 Service Limitations

  • Masayume Studio provides creative services, not programming/software development

  • AI-generated content may have technical limitations inherent to current technology

  • We do not guarantee specific technical outcomes beyond industry standards

7.2 Liability Cap

Our liability is limited to the total amount paid for the specific project in question. Masayume Studio shall not be held liable for any indirect, consequential, or punitive damages arising from the use of our services or deliverables.

8. FORCE MAJEURE

Masayume Studio is not liable for delays or failures due to circumstances beyond our reasonable control.

9. GOVERNING LAW

These terms are governed by French law. Any disputes shall be subject to the jurisdiction of French courts.

10. MODIFICATIONS

These terms may be updated periodically. Clients will be notified of significant changes affecting ongoing projects.
